Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
After 18 years of marriage, the daughter-in-law of these petitioners died in unnatural circumstances and allegation is that for non-fulfillment of dowry demand she was killed. Submission is that presumption of dowry death is not there as death was caused after more than 7 years of marriage. Husband of the victim is already in custody. There is no eyewitness of the occurrence. Considering the entire facts aforesaid, let the
Patna High Court Cr.Misc. No.37403 of 2018 (2) dt.03-07-2018 2/2 petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Basantpur Police Station Case No. 108 of 2018, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
