JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,149,341,342,323,224,225,332,504,353 and 393 of the Indian Penal Code.

The prosecution case is that the informant bail a police officer arrested one Md. Naushad, an accused in Kishanpur P.S. Case No.

of registered under sections 147,149,504,323,324,379,337 and 447 IPC but he was being released by the FIR named accused including the petitioners. It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general against the mob. The

Patna High Court Cr.Misc. No.16835 of 2016 (2) dt.20-04-2016 2/2 thrust of accusation is against Naushad. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that the petitioners were not sent up for trial but differing with the final form, cognizance has been taken. Statement to that effect has been made in paragraph 10 of the petition.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Supaul in connection with Kisanpur P.S. Case No. 18 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The learned court below shall be at liberty to cancel the bail bonds of the petitioners in case the petitioners default without any reasonable cause on three consecutive occasions. (Dinesh Kumar Singh, J) Anil/- U T
