Petitioners apprehend arrest in connection with Barauni P.S. Case No. 151 of 2022 registered for the offence under sections 290, 387 and 34 of the Indian Penal Code and
Patna High Court CR. MISC. No.51137 of 2022(7) dt.11-04-2023 2/2 section 27 of the Arms Act.
Learned counsel for the petitioners submits that petitioners have not committed any offence as alleged in the first information report and they have been falsely implicated in this case merely on basis of suspicion. As per the allegation, 4-5 rounds of firing was made, but no empty cartridge has been found in or around the market. During investigation also, no material has come against these petitioners. No independent witness has come forward to support the prosecution case. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 151 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Arvind Srivastava, J) mcv/- U T
