2. The petitioner seeks regular bail in connection with Parsa Bazar P.S. Case No. 465 of 2024 for the offences registered under Sections 8(c), 21(b) of the NDPS Act.

3. As per the prosecution case, three accused persons including the petitioner were apprehended from whose possession total 10.72 grams Smack were recovered. It is alleged that 6.42 grams Smack was found from the petitioner and 1.87 grams Smack from co-accused Bajrangi Kumar and 2.43 grams Smack from co-accused Randheer Kumar were found.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The alleged recovery of Smack comes under the intermediate quantity under the NDPS Act. Other two co-accused persons have

Patna High Court CR. MISC. No.51285 of 2025(2) dt.11-08-2025 2/2 already been granted bail by the learned Court below. Petitioner is a young boy of 21 year having no criminal antecedent. He is languishing in custody since 22.09.2024. Charge has already been framed against the petitioner and other co-accused persons. Petitioner undertakes to co-operate in the trial.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties and facts and circumstances of the case, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS, Patna in connection with Parsa Bazar P.S. Case No. 465 of 2024, subject to following conditions:- (I) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
