The petitioner seeks bail in Roh P. S. Case No. 3 of 2018 instituted for the offence under Section(s) 406, 409, 420, 120B, 467, 468, 471/34 of the Indian Penal Code. The FIR has been lodged as per direction of the District Magistrate, Nawada, alleging that petitioner and other teachers as mentioned in the written report have been appointed on the basis of forged document in different schools under Roh block District Nawada.

Allegation against this petitioner is that he was appointed as primary teacher in primary school Devand under Roh Bock, District Nawada. It has been submitted on behalf of petitioner that he never claimed to have been appointed as a

Patna High Court CR. MISC. No.49850 of 2019(2) dt.16-08-2019 2/2 teacher in primary school Devand nor has he received any salary thereof.

Learned counsel for petitioner submits that petitioner could not appear before the enquiry committee with the original papers and therefore the instant case has been lodged. Petitioner is in custody since 2.5.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM IV, Nawada in connection with Roh P. S. Case No. 3 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
