2. The petitioner seeks bail in connection with Dhoraiya P.S. Case No. 421 of 2024 instituted for the offences under Sections 103, 61(2), 238, 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per prosecution case, the accusation against the accused persons including the petitioner is of being involved in committing murder of the deceased and hiding the dead body.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as

The petitioner is the husband of the deceased and marriage was solemnized ten years before and they were also having two children out of their wedlock. There is no specific or direct allegation of any overt act against the petitioner rather the same is general and omnibus in nature. Learned counsel for the petitioner further submits that as a matter of fact the petitioner and the informant's daughter were in a consensual relationship and solemnized marriage and, the deceased has succumbed to a prolonged illness. The petitioner has no criminal antecedent and is languishing in judicial custody since 04.01.2025 without any rhymes or reason.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner, the petitioner having no criminal antecedent as also there being no specific

No.50967 of 2025(4) dt.14-10-2025 3/3 allegation against the petitioner, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Dhoraiya P.S. Case No. 421 of 2024.
