JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-07-2016 Learned Counsel for the petitioner and Opposite party No.2 informs that the parties have amicably resolved their matrimonial dispute and are living together. Both the parties have submitted in the larger interest of justice that entire proceedings arising out of Complaint Case No. 1763 of 2013 be quashed, exercising power under Section 482 of the Code of Criminal Procedure. Learned counsel appearing on behalf of the parties has taken a very fair stand and they are right in their submissions that continuance of the criminal matter may hamper their matrimonial relationship.
Pendency of the criminal case, in the facts and
circumstances of the case, lodged by Opposite party No.2 against the petitioner will not be proper.
Considering the above, I am of the view that for the ends of justice, the entire proceedings arising out of Complaint Case No. 1763 of 2013 pending in the Court of learned Sub Divisional Judicial Magistrate, Vaishali at Hajipur deserves to be quashed and is, accordingly, quashed. This application is allowed.
