The petitioner apprehends his arrest in a case under Section 392 of the Indian Penal Code.

While the informant, a Sub Inspector of Police, along with a SAP constable was returning on his motorcycle, they were intercepted by four unknown persons and were robbed of their motorcycle, mobiles etc. It is submitted that the petitioner is not named in the F.I.R. Nothing has been recovered from the possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of co-accused Amitabh Kumar. Amitabh Kumar has been granted regular bail. The Anticipatory Bail Petition of similarly situated co-accused Sumant Kumar has been disposed of vide order dated 01.03.2016 passed in Cr. Misc. No. 9570 of 2016.

No.16298 of 2016 (2) dt.06-05-2016 2/2 Considering the fact that the Anticipatory Bail Petition of a similarly situated co-accused Sumant Kumar has been disposed of with a direction to surrender before the learned court below and make prayer for regular bail, this Anticipatory Bail Petition is accordingly disposed of with a direction to the petitioner to surrender in the court below in Kutumba P.S. Case No. 58/2015 and make prayer for regular bail which shall be disposed of by the learned court below on its own merit taking into consideration that the other similarly situated co-accused have already been enlarged on regular bail.

This anticipatory bail petition accordingly stands disposed of.
