JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-08-2019 After some arguments, Ms. Roona, learned counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to challenge the order dated 24.01.2019 contained in Memo No. 155 passed by the District Programme Officer, Gaya in Aanganwari Case No. 32 of 2017 before the District Magistrate, Gaya.

Should such an appeal against the order of the District Programme Officer, Gaya be filed before the

Patna High Court CWJC No.15911 of 2019(2) dt.14-08-2019 2/2 District Magistrate, Gaya the same shall be decided by a reasoned order after hearing the parties and verifying all the facts.

In view of the new guidelines of 2019, if the District Magistrate, Gaya is of the view that the matter be heard by the Divisional Commissioner the records of the Aanganwari Case No. 32 of 2017 shall be transmitted to the Divisional Commissioner or in the alternative could ask the petitioner to prefer a revision before the concerned Divisional Commissioner. In any event, if the matter is placed before the concerned Divisional Commissioner, he would be under an obligation to pass a reasoned order in accordance with law within a reasonable period of time.

The writ petition is disposed of as withdrawn with the liberty aforesaid.
