The petitioner in this case is seeking anticipatory bail in connection with Khajauli P.S. Case No.86 of 2018 registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is the husband of the deceased and the allegation against him is that he had administered the poisonous articles to the deceased. Learned counsel submits that the occurrence as alleged has never taken place and the petitioner has falsely been implicated in this case.

Learned APP for the State has opposed the prayer for anticipatory bail.

No.48802 of 2019(3) dt.16-11-2019 2/2 Considering the facts and circumstances of the case where this petitioner is said to be the husband of the deceased Rinku Devi and the allegation is that he had played a role in administering the poisonous articles to the deceased and that the death has taken place within the premises of the matrimonial home, I am not inclined to grant privilege of anticipatory bail to the petitioner. This application is dismissed. In case the petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, the same shall be considered on its own merit without being prejudiced by the order of this Court.
