The petitioner, being husband of the complainant apprehends his arrest in connection with Complaint Case No. 1898C of 2013 in which, cognizance has been taken for the offences punishable under Sections-323, 494, 406, 498(A)/120(B) of the Indian Penal Code, pending in the court of Sri G. Mishra, Judicial Magistrate-Ist Class, Sadar, Motihari. There is allegation against the petitioner that he solemnized his second marriage in the lifetime of the complainant, who happens to be his legally wedded wife. Furthermore, there is allegation that the petitioner used to torture the complainant due to non-fulfillment of illegal demand.
In my view, it is not a fit case for grant of anticipatory bail and accordingly, the prayer for anticipatory bail
Patna High Court Cr.Misc. No.51847 of 2014 (2) dt.07-01-2015 2/2 of the petitioner stands rejected.
However, if, the petitioner surrenders before the court below within six weeks from today and seeks regular bail, the concerned court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this rejection order.
