The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

The petitioner and co-accused Matlu Manjhi allegedly assaulted with iron rod at the head of the father of the informant as a result whereof he died. Petitioner is in custody since 01.07.2017.

In the past prayer for bail was twice refused with direction to the trial Court to conclude the trial within six months. However, trial has not concluded.

Considering the period already undergone by the petitioner and there is no material to substantiate that the

No.7362 of 2021(2) dt.03-02-2021 2/2 petitioner is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No.548 of 2017/44 of 2020, arising out of Atari P.S. Case No.3 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
