The petitioner apprehends her arrest in connection with Mahila P.S. Case No.113 of 2017 registered for the offences under Sections 498(A), 323, 341, and 307/34 of the Indian Penal Code. Subsequently, Section 302 of the IPC has been added in this case.
As per the first information report, the allegation against the petitioner is that she has burnt her daughter-in-law along with her son and dying declaration was given by the deceased.
Considering the aforesaid facts, this is not a fit case for grant of anticipatory bail to the petitioner. Prayer for anticipatory bail is hereby rejected.
The case at hand is of the year 2017 but till date the
Patna High Court CR. MISC. No.7389 of 2021(3) dt.29-11-2021 2/2 petitioner has not surrendered in the court below. Accordingly, the petitioner is granted time of two weeks from today to surrender in the court below. If the petitioner does not surrender within two weeks from today then the Superintendent of Police, Nalanda at Biharsharif shall take all coercive steps to arrest the petitioner and report to this Court about the process after four weeks.
With the aforesaid observation and direction, the application is dismissed Let a copy of this order be communicated to the Superintendent of Police through FAX message and email. (Sandeep Kumar, J) BT/- U T
