This is an application seeking modification in the order dated 17.11.2014 passed in 26820 of 2014 in connection with Sherghati P.S. Case No.111 of 2014, pending before the Sub-Divisional Judicial Magistrate, Gaya.

It is pointed that original petitioner no.3, Md. Anjar had already been apprehended but this fact could not be brought into notice besides that the present two petitioners, who are petitioner nos. 1 and 2 carry two criminal cases of the year 2009 but fail to state this fact in paragraph 3 of the original application.

In view of the above, there appears no reason for any modification. Accordingly, the prayer on behalf of the petitioners is hereby refused with a direction to the petitioners to surrender before the Court below at once and seek regular bail, which shall be considered on its own merit, failing which, the court below is directed to take all coercive steps, permitted under law, to ensure their appearance/apprehension.
