JUSTICE RAVI RANJAN ORAL ORDER 06-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The Petitioners apprehend their arrest in connection with Moro P.S. Case No. 37 of 2015 registered for offence punishable under Sections 341,323,324,504,307,379/34 of the Indian Penal Code.

It is contended that though there is allegation upon the petitioners of having assaulted the informant as well as one Satyam Kumar by farsa. It is apparent from the injury report that both have received injury caused by hard and blunt substance and not by the sharp cutting weapon. That apart, one of the co-accused Baidyanath Mishra has already been granted bail by this Court

Patna High Court Cr.Misc. No.18490 of 2016 (2) dt.06-05-2016 2/2 vide order dated 28.03.2016 in Criminal Miscellaneous No. 5654 of 2016.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Dig Vijay Mishra @ Bambam @ Dig Vijay Kumar Mishra and Shivam Kumar be released on bail in the event of arrest/surrender before the Court below within a period of six weeks from today in Moro P.S. Case No. 37 of 2015, on furnishing bail bond of Rs. 10,000/- (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Darbhanga subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of criminal Procedure.
