2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 406, 420, 307, 323, 341, 380, 468, 471 and 120B of the Indian Penal Code and Section 138 of the N.I. Act.
3. The case of the prosecution is that the petitioner was working in the company of the complainant namely, A.K. enterprises and he had defalcated rupees 20 lakhs.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. During the course of hearing, learned counsel for the petitioner has submitted that the
Patna High Court CR. MISC. No.56379 of 2024(7) dt.11-02-2025 2/2 parties have compromised the case in trial Court and to support it, he has filed the certified copy of the compromise petition. Moreover, the petitioner is languishing in judicial custody since 04.04.2024.
5. Learned counsel for the complainant is also present before this Court and he has stated that in light of the compromise, order may be passed.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Complaint Case No. 1282 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Patna City.
