JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 09-12-2021 Let the defects, as pointed out by the office, be removed when called upon to do so by the office. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered in connection with Bahera P.S Case No. 12 of 2011 for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

As per prosecution case, Informant Sushil Kumar Singh has filed complaint before Bahera Police Station that some mismanagement by the postal officials of Bahera sub- post office in the honorarium given to the labourers under ManregaScheme of Gram Panchayat Ganesh Nbanauli, Balni Prakhand, Benipur, Darbhanga and Rs, 7,32,983 have been

Learned counsel for the petitioner submits that petitioner was simple Rojgar Sweak and he has not made payment under "Manerga Scheme". Petitioner has no role about the concern withdrawal of money. It can be made only on the basis of the instruction of the account holder. On similar footing co-accused Kameshwar Poddar in Cr. Misc. No. 9689 of 2017 by the co-ordinate Bench of this Court.

In the facts and circumstance of the case, let the petitioner , above named, in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P.S Case No.12 of 2011 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
