Learned AC to SC-8 by way of referring to counter affidavit filed on behalf of Respondent nos.1,3 and 4, which was filed on 11th November, 2008 submits that the claim for grant of 1st and 2nd time bound promotion has already been granted. Of course, the petitioner has claimed 2nd time bound promotion w.e.f. 16.12.1988, but since he had passed the Departmental Accounts Examination in the year 1990, 2nd time bound promotion was granted to the petitioner with effect from 29.10.1990.

Be that as it may, since none has appeared on

Patna High Court CWJC No.7068 of 2008 (2) dt.13-03-2015 2/2 behalf of the petitioner, the writ petition stands dismissed due to non-prosecution.
