JUSTICE ARUN KUMAR ORAL ORDER 16-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Sachiwalaya P.S.Case No. 49 of 2018 registered under Sections 417, 420 and 120B of the Indian penal Code.

Allegation in brief is that petitioner was apprehended by the police and in his Whatsapp message, admit-cards of number of candidates for selection to the post of constable, Bihar Police, were found and it is alleged that he had taken money of Rs. 20,000/- from each candidate for getting their clearance in the physical examination.

Submission is that except admit-cards of candidates in his Whatsapp, there is no other material and also there is no any allegation from any of the candidates that any money was given by those candidates to the petitioner and he is in custody for last

Patna High Court Cr.Misc. No.40166 of 2018(3) dt.16-07-2018 2/2 three months.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Pintu Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM II, Patna in connection with Sachiwalaya P.S. Case No. 49 of 2018.
