JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code. The accusation is of abducting the minor daughter of the informant.

It is submitted by learned counsel for the petitioners that the victim has married with one Amarjeet Sah and got her marriage registered and now she is pregnant. Victim has also filed a petition to that effect before the learned Court below on appearing personally. Moreover, the victim is 20 years of age.

It is submitted by learned counsel for the informant that the victim girl is still traceless.

Considering the rival submissions of the parties, let petitioner no.1 be released on provisional anticipatory bail for a period of six weeks and petitioner nos. 2 and 3 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12

Patna High Court Cr.Misc. No.12109 of 2015 (2) dt.24-03-2015 2/2 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Kartaha P.S. Case No.74 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The petitioner no.1 will get the victim girl appeared before the learned Court below on 6th April 2015 when the learned court below will record the statement of victim girl and if she admits that she of her own married with the petitioner no. 1 the provisional bail of petitioner no.1 will be confirmed by the learned court below, otherwise, the petitioner no.1 will surrender and pray for regular bail.
