Petitioner apprehends arrest in connection with Sadar P.S. Case No. 267 of 2017 registered for the offence punishable under sections 304B/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case and there is nothing specific alleged against this petitioner. Petitioner is a man of clean antecedent and has remained in custody for about a year.
Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail of the petitioner and submits that the lady was murdered and his dead body was
Patna High Court Cr.Misc. No.38007 of 2018(3) dt.19-07-2018 2/2 thrown away and later on due to fear of police the accused persons brought back the dead body to the house. Moreover, petitioner being the husband was very much responsible for maintaining his wife with full honour and dignity in which he failed, and as such, he does not deserves to be granted the privilege of bail.
Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The same is, therefore, rejected.
