This application for anticipatory bail arises out of Bhagwanganj P.S. Case No. 45 of 2019 for the offence punishable under Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

From the petitioner's house, the police are said to have recovered 3.15 bore rifle and some cartridges. Learned counsel appearing on behalf of the petitioner submits that the petitioner's son has valid arms licence to retain the said firearm.

In support of the said submission my attention has been drawn to Annexure-2 to this application. Considering the above submission and copy of licence, which has been brought on record by way of annexure, this application is allowed.

No.51200 of 2019(2) dt.17-08-2019 2/2 Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Masaurhi, in Bhagwanpur P.S. Case No. 45 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
