The petitioners, Manoj Sada, Naresh Sada and Lalo Mallik, apprehend their arrest in C.R. No.1298 of 2011/ T.R. No.2885 of 2014, registered under Sections 457/380/34 of the Indian Penal Code.
Baidyanath Sah raised suspicion against the petitioners that the petitioners might have committed theft in his shop, on the basis of which, Warisnagar P.S. Case No.129 of 2008 was registered.
Learned counsel for the petitioners submits that the police, after investigation, submitted final form finding the case false. Thereafter, the informant filed protest petition, on the basis of which, after enquiry, prima facie case was found against the
Patna High Court Cr.Misc. No.416 of 2015 (2) dt.07-01-2015 2/2 petitioners.
Perused the record.
Except suspicion, there appears to be no material. Having considered the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Samastipur in connection with C.R. No.1298 of 2011/ T.R. No.2885 of 2014, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Pawan/- U T
