Petitioner is in custody in connection with Bairgania P.S. Case No. 95 of 2018 for the offence under sections 272, 273, 414 of the Indian Penal Code and Section 30(A) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner is in custody since 10.5.2018. The petitioner has no criminal antecedent.

Learned counsel for the petitioner submits that in the instant case 18 liters of liquor was seized but seizure list was not prepared in accordance with mandatory provisions of law. Considering the fact that petitioner has no criminal antecedent and he has remained in custody for more than one
