Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.
Prosecution case is of kidnapping the minor daughter of informant. It is alleged that victim was recovered and she disclosed that she was kidnapped by this petitioner after administering intoxicate.
It is submitted by the learned counsel for the petitioner that 164 Cr.P.C. statement of the victim suggests that it is not a case of kidnapping and Sudarshan from whom victim performed marriage has been granted bail by a Coordinate Bench of this Court vide Cr. Misc. No. 34618 of 2015.
In view of this Court, it is a case for
Patna High Court Cr.Misc. No.16819 of 2016 (2) dt.19-04-2016 consideration of prayer for regular bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Barahariya P.S. Case No. 500 of 2014, pending in the court of learned Chief Judicial Magistrate, Siwan.
With the above observation this application is disposed of.
