JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-05-2023 The limited grievance of the petitioner, in the present case, is that after the case of the petitioner for grant of arms license was rejected by the District Magistrate, Buxar, by an order dated 23.02.2016, passed in Arms Case No.61 of 2015, the petitioner had challenged the same by filing an appeal before the learned Court of Divisional Commissioner, Patna, which was numbered as Arms Appeal No.03 of 17 and the learned Court of Divisional Commissioner, Patna, by an order dated 20.03.2018, had allowed the said appeal and remanded the matter back to the District Magistrate, Buxar for reconsideration, however, the aforesaid Arms Case No.61 of 2015 is still pending

Patna High Court CWJC No.13386 of 2022(2) dt.08-05-2023 2/2 consideration, hence the same be directed to be disposed off forthwith.

The learned counsel for the respondent-State submits that in case the aforesaid Arms Case No.61 of 2015 is still pending consideration, the District Magistrate, Buxar shall pass the final order, within a stipulated time frame, as fixed by this Court.

Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with a direction to the District Magistrate, Buxar to dispose off the aforesaid Arms Case No.61 of 2015, if not already disposed off, by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
