The petitioner Ramesh Chandra Singh apprehends his arrest in a case registered under Sections 504, 506, 409 and 420/34 of the Indian Penal Code in connection with Nawanagar P.S. Case No. 217 of 2014.
In sum and substance the informant made allegation that the petitioner took sands, cement, iron rod, chips etc. worth Rs. 1,96,000/- from his shop on credit and, therefore, issued a cheque of Rs. 1,96,965/- but the cheque was dishonoured by the bank.
Learned counsel for the petitioner submits that the petitioner filed a case for theft of the cheque. There is a dispute and at best the dispute is with regard to payment of money for the
Patna High Court Cr.Misc. No.51918 of 2014 (2) dt.05-01-2015 articles said to have been purchased from the shop of the informant.
Learned APP did not dispute the facts.
Having considered the facts that the dispute arose in a business transaction, the petitioner above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S. Case No. 217 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
