The petitioner seeks regular bail in connection with Dhaka P.S. Case No. 266 of 2021 for the offence punishable under Sections 498A, 341, 323, 354B, 504, 506 and 379/34 of the Indian Penal Code.
Allegation is of subjecting the informant to torture by her in-laws including the petitioner. Petitioner is the husband of the informant.
Mr. Prateek Tandon, learned counsel appearing on behalf of the petitioner submits that the present case relates to
Patna High Court CR. MISC. No.60866 of 2021(3) dt.05-05-2022 2/2 matrimonial dispute between the husband and the wife. Petitioner is the husband of the informant and he has made specific statement in Para-6 of the bail application that he is ready to keep the informant who is his wife and his daughter with full love and dignity. He is ready to provide both physical and financial support to his wife and daughter. Considering the specific statement made by the petitioner, court below is directed to take statement of the informant who is the wife of the petitioner in the present case and strive to reconcile the matrimonial dispute between the husband and the wife. If the court below finds it proper that the husband and the wife are willing to enter into amicable settlement of dispute, the petitioner above named may be released on provisional bail for a period of one year and if the parties do not complain against each other, the provisional bail of the petitioner shall be confirmed.
Accordingly, the present bail application stands disposed of.
