The petitioner has preferred this application for grant of regular bail in a case registered under sections 379, 341, 323, 354, 504 and 34 of the Indian Penal Code, sections 3(1)(r)(s) and 3(2)(va) of the SC and ST (Prevention of Atrocities) Act and section 8 of the POCSO Act. As per the allegations in the F.I.R. it is stated by the informant that his neighbour Sintu misbehaved with his minor daughter and made an attempt to forcibly take her on his motorcycle. On the informant going to the house of Sintu Kumar to protest against his behevour, it is stated that the accused persons including the petitioner herein who happens to be the brother of Sintu Kumar abused and beat him up. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.60899 of 2021(2) dt.17-11-2021 2/2 that the petitioner has been falsely implicated due to oblique reasons. Even as per the F.I.R. the main allegation is against Sintu Kumar while the allegation against the petitioner and others are general and omnibus in nature. The petitioner is in custody since 12.3.2021 and has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody since 12.3.2021, the Court directs the petitioner to be enlarged on bail in connection with POCSO Case no. 28 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VIII-cum-Special Judge, POCSO Act, Begusarai.
