JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-03-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bhapatiyahi P.S. Case No. 31 of 2013 registered for the offence under Sections-304(B)/120(B) of the Indian Penal Code. The petitioner No. 1 is mother-in-law, the petitioner No. 2 is Gotani whereas; the petitioner No. 3 happens to be distant relative of the petitioner No. 1.
It appears from perusal of the first information report that the marriage of the deceased had taken place in the year, 2007 and she died on 25-02-2013 within four walls of the
Patna High Court Cr.Misc. No.9007 of 2015 (2) dt.04-03-2015 2/2 house of her husband. The postmortem report of the deceased does not disclose any external or internal injury on her person. Therefore, considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioners named above, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Bhapatiyahi P.S. Case No. 31 of 2013 to the satisfaction of Chief Judicial Magistrate, Supaul subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
