04. 03.08.2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Garkha Police Station Case No. 170 of 2013 pending before the Chief Judicial Magistrate, Saran at Chapra, disclosing offences under Sections 341, 323, 324, 109, 307 and 504/34 of the Indian Penal Code.

The Informant is the father of the petitioner. The petitioner is alleged to have assaulted his own brother and on his instigation, his father was also assaulted by others. Learned counsel for the petitioner has submitted that the injuries have been found to be simple in nature. However, considering the facts and circumstances of

Patna High Court Cr.Misc. No.14783 of 2016 (4) dt.03-08-2016 the case, I am not inclined to grant the privilege of anticipatory bail. The prayer for anticipatory bail is, accordingly, rejected.
