ANJANA MISHRA ORAL ORDER 30-07-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.
The petitioner is in custody since 23.12.2017 in connection with Madhepura P.S. Case No.718 of 2017, registered under Section 379 of the I.P.C.
On the basis of confessional statement, the petitioner had been arrested along with motor cycle in connection with the said case. It is submitted that the petitioner was merely a pillion rider and that the petitioner subsequently learnt that the said motor cycle on which he was traveling was a stolen motorcycle and the petitioner has nothing to do with that.
The learned counsel for the petitioner submits that he was made an accused in Fulkaha Case No.121 of 2017 and in the said
Patna High Court Cr.Misc. No.43093 of 2018 (2) dt.30-07-2018 2/2 case, he has already been extended the privilege of bail. In view of the aforementioned facts and circumstances of the case and the period of custody, let the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura, in connection with Madhepura P.S.
