JUSTICE ALOK KUMAR PANDEY ORAL ORDER 05-08-2025 In the instant petition, petitioner has prayed for the following relief:- That the instant application is being filed in this Hon'ble court for issuance of an appropriate writ/ writs, order/ orders, direction/ directions to the Circle Officer, Sheosagar (Respondent no. 4) to comply the order dated 28.02.2024 passed in Land Dispute Resolution case no. 27/2023-
Patna High Court CWJC No.12622 of 2025(2) dt.05-08-2025 2/3 24 by learned Deputy Collector, Land Reforms, Sasram, Rohtas in favour of the petitioner in respect of Mauza-Baraila, Thana No.
43, Khata no. 172, Plot no.
358 and Rakba-91⁄2 decimals Maurusi land, which has been obtained by former owner through "Patta" and it has been endowment in the name of the father Ram Ashish Ram and paying the rent to the State of Bihar since 1965 till 1968 and Malikana receipt since 1955 to till 1963 and Respondent no. 4 has not taken any interest in the matter of grievance of the petitioner due to which any scheme for the caste of SC/ST under State of Bihar not useful.
2. Learned counsel for the petitioner submits that D.C.L.R., Sasaram, Rohtas has passed the order dated 28.02.2024 in favour of the petitioner but the said order has not been implemented as yet. When the query is made to the petitioner whether the petitioner has filed any execution petition for the implementation of the order passed by D.C.L.R., Sasaram, Rohtas, he has not replied clearly that any representation with regard to execution of the said order is pending in any competent forum.
3. Learned counsel on behalf of the State submits that petitioner has not filed any petition for the implementation of
Patna High Court CWJC No.12622 of 2025(2) dt.05-08-2025 3/3 the order passed by D.C.L.R., Sasaram, Rohtas. If petitioner files such petition for execution of the order passed by the concerned authority, the same shall be looked into.
4. Considering the facts and circumstances of the case, the writ petition stands dispose of with direction that if petitioner files execution proceeding for the execution/implementation of the order passed by the D.C.L.R., Sasaram, Rohtas, the concerned authority will pass the order, in accordance with law, after giving due opportunity of hearing to the parties concerned, without being prejudiced by the order passed by this Court, within a reasonable period of time.
