JUSTICE ARUN KUMAR ORAL ORDER 29-06-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 15.9.2017, seeks bail in Magadh Medical College, Gaya PS Case No. 147 of 2017 registered under Section 420 of the IPC.

The allegation in brief is that one Birendra Kumar introduced Ram Bidhut Kumar Singh, Director of Agriculture Department, to the informant and said that he will provide job to her brother-in-law, Rs. 6,35,000/- was transferred in the account of Ram Bidhut Kumar Singh by the informant for providing job which show that the informant was cheated.

Learned Counsel for the petitioner submits that the petitioner is son of Ram Bidhut Kumar Singh, the allegation of providing job is against him and the money was transferred in his account and not in the account of the petitioner.

Having considered the aforesaid facts and circumstances as the acquisition is specific against Ram Bidhut Kumar Singh, the petitioner, namely, Santosh Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM IV Gaya in connection with Magadh Medical College, Gaya PS Case No. 147 of 2017.
