JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code. It is alleged against the petitioner that he assaulted the informant on the head with iron rod and butt of the pistol, subsequently, other accused persons snatched jwellery and wrist watch from the informant.

It is submitted by learned counsel for the petitioner that the accusation has been levelled in the background of serious litigated relationship between the parties due to land dispute. The injury report is not record. A statement to that effect has been made in para 8 of the petition. Learned Sessions Judge has also not discussed in the impugned order about the injury. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Katra P.S. Case No. 163 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
