The petitioners are apprehending their arrest in connection with Govindpur P.S. Case No.98 of 2015 for the offences instituted under Sections 147, 148, 149 and 302/301 of the Indian Penal Code.
The prosecution case, in brief, is that on 22.1.2015, the informant along with his brother Indradeo Yadav went to village Sughri to see Durga Puja fair and when arrived at 06.30 p.m. at Rajwari Tola of village Sughri the informant's brother demanded dues money Rs.5,000/- from Rambali Ram of village Sughri upon which Rambali Ram started altercation with the informant's brother and abused him. No.15592 of 2016 (2) dt.03-05-2016 2/3 Munni Ram, Karu Ram s/o Jagdish Ram, Ratan Ram, Naresh Ram, Vijay Ram, Karu Ram s/o Sukar Ram and Chhotelal Ram having lathi, Bhala, Tangi, Garasa surrounded the informant's brother uon which the informant and others wanted to pacify the matter but Ram Bali Ram inflicted a Tangi blow due which he sustained injury on his neck and all the accused persons dragged the informant's injured brother to the house of Dewa Ram where Karu Ram assaulted the informant the informant's brother on his head twice with Tangi.
It is submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners have falsely been implicated in the present case. No specific injury has been attributed against the petitioners except that they were also present at the time of occurrence on the P.O. The main allegation is against one Ram Bali Ram and Karu Ram.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R. and the petitioners have participated in the alleged crime.
Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioners. Same is rejected. Anyhow, if the petitioners surrender in the court below, same shall be considered on its own merit without being
Patna High Court Cr.Misc. No.15592 of 2016 (2) dt.03-05-2016 3/3 prejudiced by this order taking into account that no injury has been attributed against the petitioners.
