JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-09-2018 Heard learned counsel, Mr. Murari Narain Chaudhary, for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Raghopur P.S. Case No.14 of 2017, S.T. No.106 of 2017, registered under Sections 366(A)/34 of the Indian Penal Code.
Mr. Choudhary submits that the victim has joined wedlock with Mahendra Kumar Yadav, Mr. Chaudhary has placed reliance on Annexure-'3', the certificate issued by Mukhiya and Sarpanch for the aforesaid purpose.
Considering the fact that the victim has joined wedlock and residing peacefully at her Sasural and petitioner has remained in custody for nearly one year and eight months and similarly circumstance, other accused have been granted bail, let the
Patna High Court Cr.Misc. No.51555 of 2018 (2) dt.12-09-2018 2/2 petitioner be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court, i.e., F.T.C.-I, Supaul, in connection with Raghopur P.S. Case No.14 of 2017, S.T. No.106 of 2017, with condition that one of the bailor should be either Mukhiya or Sarpanch who has issued certificate, as contained in Annexure-3 to the petition for grant of regular bail.
