The petitioner apprehends his arrest in Ziradei P.S. Case No. 66 of 2014, registered for the offences punishable under Section 420 and other Sections of the Indian Penal Code and under Section 7 of the Essential Commodities Act.

Learned counsel for the petitioner submits that the petitioner is the owner of the house which was let out to one Vijay Kumar the agent of S.F.C. Vijay Kumar was authorized to purchase paddy and wheat from the farmers. It is submitted that from perusal of the entire FIR, no allegation is made out against the petitioner except the fact that the house belongs to the petitioner.

Having considered the facts that from the FIR itself it

No.3143 of 2015 (2) dt.27-01-2015 appears that the informant made telephonic contact with the branch manager Someshwar Pandey who disclosed that Vijay Kumar have taken the house on rent from Sudhir Kumar Jaiswal, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Ziradei P.S. Case No. 66 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
