JUSTICE RAKESH KUMAR ORAL ORDER 23-03-2015 Sri Bakshi S.R.P.Sinha, learned senior counsel, who was assisted by advocate on record, in presence of Sri K.D. Chatterjee, learned senior counsel for the petitioner and learned AC to GA No. 11, submits that in view of nature of dispute as well as the fact that the case pertains to a dispute under the provisions of Bihar Tenants Holding (Maintenance Of Records) Act, 1973 which is a Schedule Act under Section 9 of the Bihar Land Tribunal Act, 2009, this matter may be referred to the Tribunal.

Learned counsel for the petitioner Sri K.D. Chatterjee, does not oppose the prayer. However, he submits that interim order of stay dated 21.4.2009 may continue.

In view of the facts and circumstances as well as in view of proviso to Section 15 of the Bihar Land Tribunal Act,

Patna High Court CWJC No.8013 of 2008 (6) dt.23-03-2015 2/2 2009, Registry is directed to transmit the record of this case to the Tribunal forthwith. It goes without saying that order of stay shall continue during the pendency of the case. (Rakesh Kumar, J) Praful/- U
