Having regard to the fact that when the petitioner had retired on 31st of December, 2007, his entire retirement benefits as per his entitlement of that day was already made to the petitioner, the grievance of the petitioner raised in this writ application for further enhancement of post retirement benefit on the basis of judgment of this Court in the case of passed in C.W.J.C No. 20478 of 2012 (Ramadhar Sharma vs the State of Bihar & Ors) disposed of on 08.07.2014, would first require to be examined by the authorities of the State Government for deciding as to whether the petitioner
Patna High Court CWJC No.184 of 2015 (2) dt.06-02-2015 will be entitled for any benefit in terms of the law laid down in the aforementioned judgment in the case of Ramadhar Sharma (supra).
That being so, if the petitioner files his representation explaining his case with evidence as also judgment of this Court in the case of Ramadhar Sharma (supra), the respondent no. 2, Director, Secondary Education will take appropriate decision and also ensure that if any further amount becomes payable to the petitioner, the same also must be explained to him within a period of six months from the date of receipt of this order.
With the aforementioned observation and direction, this application is disposed of.
