The petitioner seeks bail in connection with Bhagwanpur P. S. Case No.92 of 2021, instituted for the offences under Sections 304(B)/ 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 02.08.2021, charge-sheet has been submitted in the case and has antecedent of two cases and the petitioner is the father-in-law of the deceased. The learned counsel for the petitioner submits that the informant alleges that the daughter was married to Vikash Kumar Rai about five years ago and after some days of marriage, the accused persons including the petitioner were demanding dowry from his daughter and when the informant showed his inability to give Rs. Four Lacs as dowry, they

The learned counsel for the petitioner submits that informant is not an eye witness to the occurrence and the allegation is general and omnibus in nature. The husband is in custody since 11.04.2021. Petitioner has been implicated merely because he is father-in-law of the deceased. It is further submitted that petitioner is separate in mess and property. The learned A.P.P. for the State opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and the husband of the deceased is already in custody since 11.04.2021, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1, Vaishali at Hajipur in connection with Bhagwanpur P. S. Case No.92 of 2021. The application stands allowed.
