Petitioner seeks bail in connection with RPF/Bhagalpur P.S. Case No. 450 of 2018, Checking Case No. 560 of 2018 for offences punishable under Sections 143 (1) of the Railway Act.

The prosecution case, as lodged by the informant, is that while he had booked a ticket for his sister and the petitioner, who is the owner of Cyber World and Travels engaged in ticket booking of Railways, took Rs. 850/- more for tatkal ticket and stated that the berth would be confirmed but when the berth was

Patna High Court Cr.Misc. No.40848 of 2018(3) dt.13-07-2018 2/3 not confirmed, the informant came for refund of his money but the money was not refunded to him. On the basis of the said written complaint, the Inspector Incharge RPF, Bhagalpur has lodged the present complaint.

It has been submitted by the learned counsel for the petitioner that he is innocent and is an authorised person dealing with e-ticketing of Railways and the complainant would get the refund from the Railways itself if the tickets were not confirmed. He submits that false allegation has been levelled against him, he bears no criminal antecedent and he did not take excess money as the tickets are booked online. The petitioner is languishing in judicial custody since 06.05.2018 and he undertakes to co-operate in the investigation of the case. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhagalpur, in connection with RPF/ Bhagalpur P.S. Case No. 450 of 2018, Checking Case No. 560 of 2018, subject to the condition that one of the bailors would be a close
