The petitioner has renewed his prayer for grant of bail in a case registered under sections 363, 374 and 34 of the Indian Penal Code and section 79 of the Juvenile Justice Act. The earlier application for bail of the petitioner was rejected vide order dated 6.4.2022 passed in Cr. Misc. no.52586 of 2021.
As per the prosecution case, it is stated that the accused persons including the petitioner herein were involved in taking away minor children for the purpose of sale. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He is in custody since 11.6.2021. As per the deposition of the
Patna High Court CR. MISC. No.50252 of 2022(2) dt.09-11-2022 2/2 witnesses examined in course of trial, which is Annexure 3 series to this petition, the witnesses have not supported the prosecution case and some of them have been declared hostile. The petitioner undertakes to cooperate in the trial. Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody since 11.6.2021 and the contents of the deposition of the witnesses in course of trial brought on record as Annexure-3 series to this petition, the Court directs the petitioner to be enlarged on bail in connection with Supaul P.S. Case no.583 of of 2018 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st-cumSpecial Judge, Supaul.
