The petitioners being the parents and uncle of the husband of the complainant are apprehending their arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.
It is submitted by learned counsel for the petitioners that the petitioners were at Delhi at the relevant time for the treatment of Kumod Singh, the son of petitioner nos. 1
Patna High Court Cr.Misc. No.18717 of 2016 (3) dt.21-07-2016 and 2, who was suffering from cancer and subsequently he died. The accusation is omnibus and general against entire in-laws family and the thrust of accusation is against the husband of the complainant. The petitioners are still ready to keep the complainant in the matrimonial house.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Vaishali at Hajipur in connection with Complaint Case No. 2153 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
