The petitioners apprehend their arrest in connection with Buxar (Muffasil) Chausa P.S. Case No.09 of 2021 instituted under Sections 498(A), 304(B) IPC and 3⁄4 Dowry Act. As per the prosecution story, the informant has alleged that the lady was married to the Guddu Kumar but she was poisoned to the death.

Learned counsel for the petitioners submit that petitioner no.1 is uncle of Guddu Kumar while the petitioner no.2 is the cousin brother and they had no role to play but have been dragged in this case. The further submission is that Guddu Kumar has since been granted bail and they further do not have

Taking into account that they are family members of Guddu Kumar being distantly related, they do not have criminal antecedent and ultimately they have to face the trial, this Court is inclined to extend them privilege of anticipatory bail. Let the petitioners be released on bail, in the event of their arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Buxar (Muffasil) Chausa P.S. Case No.09 of 2021 to the satisfaction of learned Chief Judicial Magistrate, Buxar, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Rajiv Roy, J) Prakash Narayan /- U T
