JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 448, 385, 307 and 283/34 of the Indian Penal Code.
It is alleged that on 04.11.2014 at 9 AM, the accused persons were cutting the soil from the passage and on protest being made accused persons assaulted the son of the informant with butt of the rifle and country made pistol when petitioner nos. 3 and 5 resorted to fire which hit on the door of the informant. It is submitted by learned counsel for the petitioners that in the background of serious land dispute, the accusation has been
Patna High Court Cr.Misc. No.11068 of 2015 (3) dt.06-05-2015 2/2 levelled. A supplementary affidavit has been filed making statement in para 2 of the same that no one received any injury. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Gopalganj P.S. Case No. 511 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
