JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2015 Heard learned counsels for the petitioner and the State. The petitioner being the Panchayat Mukhiya is apprehending arrest in a case registered for the offences punishable under Sections 420, 406, 409 and 120B/34 of the Indian Penal Code.

The accusation is of purchasing solar lights worth Rs. 1.64 lakhs in the year 2007-08 to 2009-10 from the other agency in violation of the instruction for purchase from BREDA or BELTRON agency.

It is submitted by learned counsel for the petitioner that the instruction for purchase of solar from BREDA or BELTRON was issued after actual purchase of the solar lights and the case has been registered after 6-7 years of the initial purchase. It is further submitted that Panchayat Secretary has been granted bail by this

Patna High Court Cr.Misc. No.10503 of 2015 (2) dt.17-03-2015 2/2 Court vide Cr. Misc. No. 2585 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar in connection with Simri P.S. Case No. 182 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
