JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-02-2019 With reference to paragraphs-4 and 5 of the show cause learned counsel representing the opposite parties submits that University has already paid a sum of Rs.17,96,214/- to the petitioner vide Cheque No. 443684 dt. 14.05.2018. However, in paragraph-6 there is a statement that fixation has been sent to the Pay Verification Cell, Patna and only on receipt of verification report final settlement shall be done. Considering the aforesaid, the present proceeding is dropped and the application stands disposed of. However, the University is directed to positively supply the final calculation as to entitlement of the petitioner

Patna High Court MJC No.1480 of 2017(7) dt.25-02-2019 2/2 within a period of 30 days from today and in the event the petitioner is aggrieved by final calculation, liberty shall be available to the petitioner to challenge the same in accordance with law before an appropriate forum. If it is not communicated to the petitioner within the aforesaid time, liberty shall be available to him to file affidavit for revival of the present proceeding.

It is made clear that the University has to take decision on its own and not on the report of Pay Verification Cell and this Court has already held out that Pay Verification Cell has absolutely no jurisdiction to deal with such matters of the University.
