2. The petitioner is in custody since 16.05.2023 in connection with Rampur P.S. Case No. 434 of 2017 registered for the offence punishable under Sections 307/427/506 of the Indian Penal Code, Sections 3/4/5 of the Explosive Substances Act and Section 27 of the Arms Act.

3. The prosecution story in short is that the petitioner and the other co-accused persons are said to have fired indiscriminately in the air to terrorize the family of the informant. The are also alleged to have exploded bomb at night inside the house of the informant.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to dirty village politics and old enmity. He further submits that no overt

Patna High Court CR. MISC. No.52236 of 2023(2) dt.23-08-2023 2/2 act has been alleged against this petitioner. The petitioner has no criminal antecedents as stated in paragraph No. 3 of the bail application.

5. However, learned A.P.P. appearing on behalf of the State vehemently opposed the bail application.

6. In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail after completion of six months in custody, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Rampur P.S. Case No. 434 of 2017.

7. The petitioner is directed to appear before the Rampur Police Station on the 1st Sunday of each month. (Sandeep Kumar, J) Saif/- U T
