JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2015 The petitioners are apprehending their arrest in a case registered under sections 341, 323, 427, 379, 307/34 of the Indian Penal Code.
It is alleged that petitioner Heera Devi and her son Sanjay Kumar were selling mango in front of his mobile shop which was objected by the wife of the informant. At this co-accused Sanjay Kumar assaulted the wife of the informant. Then, the accused
Patna High Court Cr.Misc. No.181 of 2015 (2) dt.08-01-2015 2 / 2 persons assaulted the informant, his wife and son and co-accused Sanjay Kumar assaulted the informant.
It is submitted by the learned counsel that the allegation of causing head injury to the informant is against co-accused Sanjay Kumar. The accusation of making assault is not specific against the petitioners.
It is stated in paragraph no.3 of the petition that the petitioners have got no criminal antecedent.
Considering the nature of accusation and the injury report of the informant, his wife and son, let the above named petitioners be enlarged on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S.
